La presente obra trata de ofrecer las claves para determinar el régimen jurídico aplicable a las operaciones garantizadas con bienes inmateriales, así como valorar en qué medida son relevantes las normas relativas a la protección de los derechos de propiedad industrial e intelectual. Se realiza un análisis pionero en Derecho comparado de estas operaciones de garantía en distintos ordenamientos jurídicos. La posibilidad de otorgar en garantía los derechos de propiedad industrial e intelectual se encorseta en regímenes nacionales que no facilitan el tráfico económico, por lo que las sociedades titulares de tales derechos pierden la oportunidad de acceso a una financiación crediticia en mejores condiciones. Sin embargo, en un mundo globalizado, se amplían las perspectivas de financiación cuando pueden servir como garantía real los bienes inmateriales.
